By accessing or using our platform, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you cannot access or use our platform.
This document constitutes the operating rules of the marketplace of the website “sxediomodas.gr”.
The Terms are a legally binding contract between you and the management of “Sxedio Modas”.
The following terms have been agreed upon between the administrator of the website “Sxedio Modas” and the registered sellers on it.
Sellers who wish to participate in the marketplace must create an account and submit an application to become members. The selection and approval of sellers’ applications will be done by the marketplace administrator.
Sellers must select the product or service categories they offer and register them in their account.
The “Sxedio Modas” will receive a commission of 8% for each transaction made through the platform (+24% VAT). The “Sxedio Modas” will always issue an invoice for its commissions. This commission can be deducted from the sales amount before the balance is paid to the seller. The commission is calculated based on the total transaction, including shipping expenses and VAT. Sellers will have the option to make automatic withdrawals on a weekly or monthly basis from their dashboard. The system has been automated to process payments every Thursday for weekly withdrawals and on the first Monday of each month for monthly withdrawals, after orders have been completed. The cost of money transfer for bank deposits is borne by the sellers and will be included in the invoice. The cost is €1.50. Sellers who choose to be paid via PayPal are not subject to money transfer charges, unless including currency conversion. The currency conversion cost is 3.00% above the base exchange rate.
Sellers are obligated to provide information regarding the cancellation and return policy for the products or services they offer. This includes possible deadlines, return fees, and other relevant information. As consumers, we have the right to cancel our purchases within 14 days from the day of receipt, without the need to provide any explanations to the sellers, according to the law. In this case, sellers are required to initially accept the return, verify that the products are in their original condition, and then refund the transaction amount to the marketplace (if it has already been paid to the seller), so that it can be refunded to the consumer, unless agreed otherwise. In cases where payment is made in cash upon delivery, sellers are responsible for refunding the amount.
Sellers must ensure that their products or services meet the required standards of quality and safety. Additionally, the provision of information regarding materials, manufacturing processes, or standards used may be required.
Sellers and customers should be aware that their personal data will be collected and processed by “Sxedio Modas” in accordance with applicable laws on personal data protection.
The administrator of “Sxedio Modas” may promote the website and the products/services of sellers through various means, such as advertisements, social media, or other promotional activities.
We understand that your personal information is important to you, and that’s why it is important to us as well. Our Privacy Policy explains how your information is collected, used, and disclosed when you use our services. By using our services, you also agree that we may process your information in the ways described in our Privacy Policy, so please take a moment to read it here.
Both the individuals at SxedioModas.gr and the sellers process personal information of members (such as the buyer’s name, email, and shipping address) and are considered separate and independent data controllers of buyers’ personal information in accordance with European law. This means that each party is responsible for the personal information it processes while providing the services. For example, if a seller accidentally discloses the name and email address of a buyer while fulfilling another buyer’s order, the seller, and not Sxedio Modas, will be responsible for this unauthorized disclosure.
However, if you (as a seller) and Sxedio Modas are considered joint data controllers of the buyers’ personal information, and if Sxedio Modas is legally pursued, fined, or required to pay expenses due to something you did (or didn’t do) as joint data controllers of the buyers’ personal information, then you agree to defend and indemnify Sxedio Modas in accordance with Section 7 below.
You will need to create an account with SxedioModas.Gr in order to use certain services we offer. The conditions for creating an account are described below:
The content you upload using our services is your own content (so let’s refer to it as “Your Content”). We make no claims to Your Content, including anything you post using our services, such as store names, profile photos, listing photos, listing descriptions, reviews, comments, videos, usernames, and so on.
A. Responsibility for Your Content. You understand that You are solely responsible for Your Content. You declare that you have all necessary rights for any proprietary parts of Your Content and that you do not infringe upon the rights of third parties by posting it.
B. License to Use Your Content. By posting Your Content through our services, you grant SxedioModas.gr and, upon authorization from Sxedio Modas, directly under its jurisdiction, a license to use it. We do not claim ownership of Your Content, but we have your permission to use it to help Sxedio Modas operate and grow. By doing so, we do not violate any of your rights over Your Content, and we are able to promote it. For example, you acknowledge and agree that Sxedio Modas may offer promotions on the website, from time to time, that may be related to your listings or other listings on Sxedio Modas, either for you or for its buyers.
C. Rights You Grant to Sxedio Modas. Here is the legal version of the last section. By publishing Your Content, you grant Sxedio Modas (and its lawful owner), under authorization from Sxedio Modas, a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content. This allows us to provide the Services and promote Sxedio Modas, your store on Sxedio Modas, other stores and listings, or the Services themselves, in any form and through any channels, including all services of Sxedio Modas, our partners, or third-party websites or advertising platforms. By using our services, you agree not to file any claims or take any legal action against us regarding the use of your content, including claims related to moral rights or rights of publicity. You also acknowledge our legitimate interest in using it, in accordance with the scope of this license, to the extent that Your Content contains any personal information.
This sounds like a lot, but it is necessary to keep this website running.
Let’s look at some examples: If you upload a photo or video of a listing in your store on Sxedio Modas, we have permission to display it to buyers and adapt it to appear properly on a mobile device for a buyer’s convenience. If you post a description in Greek, we have the ability to translate it into English so that a buyer in Europe can read the description of your item. If you upload a beautiful photo or video of your latest products, we have the ability to showcase it – often along with the name and image of your store – on our homepage, in one of our partner blogs, or even on an advertising banner to help promote your business and Sxedio Modas.
D. Report Illegal Content. Here at Sxedio Modas, we have great respect for intellectual property rights, and we are committed to following the appropriate legal procedures to remove any illegal content from our services. If content that belongs to you or for which you have rights has been posted on our services without your permission and you wish to have it removed, please follow the steps outlined in our policy for handling copyright infringement.If your content is accused of infringing someone else’s intellectual property, we will take appropriate action, such as disabling it. We will notify you if such a situation occurs.
E. Inappropriate, False or Misleading Content. That should go without saying, but there are certain types of content that we do not allow to be posted on our Services for legal or other reasons. You agree not to post content that is demeaning, threatening, defamatory, inappropriate, violent, or violates our Policy on Prohibited Items. You also agree not to post false or misleading content or use the Services in a deceptive or misleading manner.
We provide you with a limited, non-exclusive, non-transferable, and revocable license to use our Services, subject to the Terms and the following specific restrictions:
A. Do not use our Services to violate the law. We agree that you will not violate any laws in relation to the use of our Services. That includes local, regional, national, and international laws that apply to you. It is important to comply with all applicable laws while using our Services. For example, it is your responsibility to obtain the necessary licenses or permits required for your store and to comply with the applicable legal requirements in the respective jurisdictions. This includes the sale and delivery of your items, such as age verification upon delivery where required by law. The sale of any product that violates any laws is not allowed. You must comply with our Prohibited Items Policy and refrain from engaging in fraud (including making false claims or violation notices), theft, competitive behavior, threatening behavior, or any other illegal acts or crimes against Sxedio Modas, another user, or a third party.
B. Please pay your bills. You are responsible for paying all fees owed to Sxedio Modas. Except as otherwise set forth below, you are also solely responsible for collecting and/or paying any applicable tax on any purchase or sale you make through our Services.
C. Don’t steal ours. Do you agree not to make any attempts to seek information from our Services’ pages, extract data, or reverse engineer the code of the Services (including our Intellectual Property and Seller Content) without our explicit permission?
D. Do not attempt to damage our systems. You agree not to interfere with or attempt to disrupt our Services, for example, by distributing viruses, excessive requests to our website or platform, or other harmful computer code.
E. Share your ideas. We love your suggestions and ideas! They can help us improve your experience and our Services. Any ideas, suggestions, offers, feedback, or comments you submit regarding our Services are considered non-confidential. You agree that Sxedio Modas has the right, but not the obligation, to use your suggestions without restriction and without any compensation to you.
Termination by your own choice. We’ll be sad to see you go, but you can terminate your Sxedio Modas account at any time from your account settings. Termination of your account will not affect the availability of any of your content that you have posted through our Services prior to termination. Oh, and you’ll have to pay off any outstanding bills.
Ended by Sxedio Modas. Sxedio Modas may terminate or suspend your account (and any other account we determine to be related to your account) and your access to the Services if we have reason to believe that you, your content, or your use of the Services are in violation of our terms. If we do, it is important that you understand that you have no contractual or legal right to continue using our Services, for example, to sell or buy on our website. Generally, Sxedio Modas will notify you that your account has been terminated or suspended unless you have repeatedly violated our terms or we have legal or regulatory reasons that prevent us from notifying you.
If you or Sxedio Modas terminate your account, you may lose any information about your account, including your content.
Maintenance of terms. The terms will remain in effect even after your access to the service ends or you stop using the service.
Items You Purchase. You understand that Sxedio Modas does not manufacture, store or inspect any of the items sold through our Services.
We provide the online space; items in our marketplace are produced, listed and sold directly by independent sellers, so Sxedio Modas cannot and does not make any guarantees as to their quality, safety, authenticity or legality. Any legal claim related to an item you purchased must be brought directly against the seller of the item. You release Sxedio Modas from any claims related to items sold through our Services, including defective items, misrepresentations by sellers, or items that caused personal injury (such as product liability claims).
People You Interact With. You may use the Services to interact with other people, either online or in person. However, you understand that we do not monitor users of our Services, except for certain compliance and legal obligations, and you release us from any liability related to your interactions with other users. Please be careful and exercise caution and judgment in all interactions with others, especially if you are meeting someone in person.
Third Party Services. Our Services may contain links to third-party websites or services that we do not control (for example, links to Facebook, Twitter and Pinterest). When you access these third-party services, you do so at your own risk. Third parties may require acceptance of their own terms of use. Sxedio Modas is not a party to these agreements; they are solely between you and the third party.
In case a dispute arises between you as a user and Sxedio Modas, there are mechanisms for its resolution. We recommend that you contact Sxedio Modas support to seek a solution and explain your objection.
We may update these Terms from time to time, including adding entirely new terms and deleting existing terms. If the changes are material, we will notify you in advance by posting the changes through the Services and/or sending you an email or message about the changes. Your use of our Services after the effective date of the changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you can close your account.
